| dc.description | The aim of this article is to present practical problems associated with adopting the
resolution on the expiry of the mandate of the councilor due to the loss of their eligibility
or its lack on election day. The examination of the issue leads to the conclusion that the
fulfillment of the condition for having the right to be elected, that is the requirement to reside
in a specific locality and at a specific address with the view of permanent stay, needs
individual assessment on the case by case basis. Moreover, one can observe that there are
no uniform procedural guarantees related to collecting of evidence prior to the discussed

| dc.description.abstract | Celem artykułu jest przedstawienie praktycznych problemów związanych z podejmowaniem
uchwał w przedmiocie wygaśnięciu mandatu radnego z powodu utraty prawa
wybieralności lub nieposiadania go w dniu wyborów. Podjęte rozważania prowadzą do
wniosku, że kryterium posiadania prawa wybieralności, jakim jest zamieszkiwanie w określonej
miejscowości pod oznaczonym adresem z zamiarem stałego pobytu wymaga indywidualnej
oceny każdego stanu faktycznego. Ponadto brak jest jednolitych gwarancji
procesowych związanych z gromadzeniem materiału dowodowego przed podjęciem omawianej
