Niektóre zagadnienia dotyczące świadczeń pielęgnacyjnych w praktyce organów samorządowych i orzecznictwie sadów administracyjnych

Abstract

The paper presents issues relating to the specialized part of the social security system, related to the satisfaction of essential needs of the family in the care of the needy, in particular - for the disabled. This issue is related specifically to two statutes: the Law of 12 March 2004 on Social Assistance and Act of 28 November 2003 on Family Benefits. The evolution of legal regulation and case law authorities and administrative courts in matters of the dubious, such as: 1) the right of the disabled person who is married to get attendance benefit; 2) the admissibility of the attendance benefit for farmers; 3) form of the decision on social security contributions in case of a person collecting the attendance allowances; 4) amount of nursing allowance entitlement for an incomplete month. Some de lege ferenda suggestions are made to comprehensively amend controversial legislation, taking into account the achievements of the doctrine and jurisprudence.
