dc.description.abstractThrough a dozen or so recent years there has been a noticeable increasing tendency in temporary employment rate. Employment agencies, accounted for their effectiveness, are playing more and more significant role in the improvement of the situation on the job market. The number of employers users who want to use their services, and as a consequence, the number of temporary employees, too. Therefore, the question about the status of employment agencies which provide services in the field of temporary work seems to be quite essential, especially in the interest of temporary employees. In the conclusion of the above reflections, the author assumes that the sensu largo employer in temporary employment is an employment agency which provides services in the field of temporary work. This means that such an agency uses rights and performs duties ascribed to an employer in relation to an individual temporary employee bound with it by an employment contract as well as in relation to other entities, e.g. a country, a union organisation, an employer user. However, the status of a sensu stricto employer (in a functional term) should be ascribed to an employer user. Above all he decides about time and organisation of work, way of performance and executes observing labour safety and hygiene regulations. This subordination of a temporary employee to an employer of a user appears ex natura in a sense. This results from the nature of this form of employment, a temporary employee performs temporary work exclusively in favour of an employer user after all.en_US
