| dc.description | The amendment of the Act on Protection of Forest and Agricultural Lands of 3 February1995
gave rise to disputes over authority between heads of the district and voivodship
marshals. The reason for these disputes is the absence of precise legal regulations that
would clearly indicate the authority competent to recover any overdue or running debts
and annual fees related to the exclusion of agricultural land from production. The article
discusses problems related to the assignment of tasks of the creditor and the enforcement
authority of claims to the voivodship marshals derived from income related to the exclusion
of agricultural lands from production. | en_US |
| dc.description.abstract | W związku ze zmianą ustawy z dnia 3 lutego 1995 r. o ochronie gruntów leśnych
i rolnych 1 stycznia 2011 r. rozpoczęły się spory kompetencyjne pomiędzy starostami
a marszałkami województw w związku z brakiem precyzyjnej regulacji prawnej, która w sposób jednoznaczny wskazywałaby organ właściwy do windykacji zaległych i bieżących
należności i opłat rocznych związanych z wyłączeniem gruntów rolnych z produkcji.
Opracowanie poświęcone jest problemom związanym z powierzeniem marszałkowi
województwa zadań wierzyciela i organu egzekucyjnego należności pieniężnych z tytułu
