Abstract

Certain behaviour consisting in creation and presentation of art may formally satisfy the criteria of acts prohibited by law and qualified as offences or misdemeanours. They may be, however, treated as circumstances repealing their unlawfulness provided certain conditions are met. But it is necessary to be cautious regarding such assessments because such behaviour may infringe different interests protected by law.
