Abstract

The article is an analysis of the problems associated with motherhood in a historical and modern perspective. Initially, the legal systems recognize the principle of legal certainty of motherhood, which was relatively easy to prove. If there were appeared some legal problems that they relate to fatherhood. The situation changed with the development of new technologies of procreation. It became clear then that not only fatherhood but motherhood also can be loaded with a margin of uncertainty. The analysis also includes the basic rules of modern legal systems and the practice of jurisprudence, which affected the standard of understanding of surrogacy. At the same time high lighted were the main challenges a rising from the possibilities of modern medicine and signalled was the lack of adequate regulation in the legal systems.
