Ograniczenie, zawieszenie i pozbawienie władzy rodzicielskiej jako instytucje prawa rodzinnego służące ochronie dzieci

Abstract

The Family and Guardianship Code regulates the legal institutions of limitation, suspension and deprivation of parental authority. The objective of this article is to analyze these three institutions devised to ensure protection of children from their nearest relatives, i.e. their parents. Considering the character of the matter, any intervention on the part of the court, especially in cases concerning the limitation or deprivation of parental authority, is to be deemed as very far-reaching. That is why, when resorting to such measures the courts should first of all act upon the principle of wellbeing of the child that amounts to one of the most precious values enshrined in the legal system. In the article the analysis of both the legal acts and jurisprudence has been conducted.
